1. Introduction

Welcome to Whole Body MRI Pty Ltd (“Whole Body MRI™,” “we,” “us,” or “our”), operating in Gold Coast, QLD, Australia. Our services allow you to coordinate magnetic resonance imaging (MRI) scans and other related imaging services (the “Services”) with our authorised Partner Clinics.

By viewing, accessing or using our website (the “Site”)—whether by browsing, creating an account, scheduling a service or otherwise engaging with our Services – you agree to comply with and be bound by these Terms and Conditions (the “Terms”). If you do not agree with these Terms, you may not access, use, or engage with our Services.

2. Important Notices and Medical Disclaimer

No Emergency Services: Do Not Use Our Services If You Think You May Have a Medical Emergency. If you are experiencing a medical emergency, call 000 immediately, or visit your nearest emergency department. 

No Doctor-Patient Relationship

Whole Body MRI™ is not a healthcare provider and does not provide medical advice, diagnoses, or treatment. Our role is limited to offering educational content, facilitating imaging services through our Partner Clinic(s), and providing administrative support. Any decisions regarding diagnosis, treatment, or medical care should be made solely by your qualified healthcare provider.

The Services and any information provided by Whole Body MRI™ are for informational purposes only and should never be used as a substitute for professional medical advice, diagnosis, or treatment. You acknowledge and agree that it is your sole responsibility to seek appropriate follow-up care and further evaluation from a qualified healthcare provider after receiving any results or reports from our Services.

You should always consult a qualified healthcare professional for any questions or concerns about your health, including whether to partake in our Services. Do not disregard or delay seeking professional medical advice based on information obtained through our Services.

3. Our Services

3.1 Imaging Services

Whole Body MRI™ coordinates and facilitates full-body MRI scans and related imaging services at our Gold Coast Partner Clinic MBR Health. Our Services include:

  • Scheduling and coordinating imaging appointments
  • Facilitating communication between you and our Partner Clinics
  • Providing reports generated by qualified radiologists

3.2 Limitations

We do not provide medical advice, diagnosis, or treatment. The results of your scans are for informational purposes only and should be interpreted by a qualified healthcare professional.

4. Account Registration and Security

To access certain features of our Services, you may be required to create an account. You agree to provide accurate, complete, and current information during registration and to update such information as needed.

You are responsible for safeguarding your account credentials and agree not to disclose your username or password to any third party. You must notify us immediately of any unauthorised access or use of your account.

Whole Body MRI™ and Partner Clinics are not responsible for unauthorised access resulting from the user’s failure to safeguard their credentials.

5. Payment Terms

Whole Body MRI™ operates on a cash-pay basis and does not accept Medicare, private health insurance, or other government-funded programs and requires pre-payment to our Partner Clinic prior to booking. By using our Services, you agree to pay all fees associated with the Services as displayed at the time of booking.

Payment may be processed through third-party payment processors (e.g. Stripe, Square). By providing a valid payment method, you authorise us (or our third-party payment processor) to charge the applicable fees. Any failure to settle payment may result in suspension or termination of Services.

6. Cancellations and Refunds

6.1 Cancellation Policy

You may cancel or reschedule your appointment up to 3 business days before the scheduled appointment without penalty. Cancellations made within 2 business days of the appointment may be subject to a cancellation fee, which may vary depending on the policies of Whole Body MRI™ or the Partner Clinic providing the service.

Please note that different cancellation policies may apply depending on whether the fee is imposed by Whole Body MRI™ or the Partner Clinic. Whole Body MRI™ is not responsible for Partner Clinic cancellation policies if they differ from our own.

6.2 Refund Policy

Refunds, if applicable, will be issued at the sole discretion of Whole Body MRI™ or our Partner Clinic(s) in circumstances where services were not delivered due to unforeseen circumstances, including but not limited to:

  • Technical malfunctions or equipment failure
  • Operational issues beyond our control

Refunds will not be issued for:

  • Failure to attend your scheduled appointment
  • Cancellation outside
  • User error, including scheduling mistakes or misunderstanding of service details

Refund requests must be submitted in writing to Whole Body MRI™ within a reasonable time after the missed or disrupted service. Where deemed appropriate, refund processing time may vary depending on the payment method used.

7. Privacy and Data Protection

We take your privacy seriously. Our Privacy Policy, available [here], explains how we collect, use, and protect your personal information. By using our Site and Services, you consent to the collection and use of information as outlined in our Privacy Policy.

8. Prohibited Uses

You agree not to:

  • Use our Services for any unlawful, fraudulent, or malicious purpose
  • Misuse, disrupt or tamper with the Site or any related systems
  • Attempt to gain unauthorised access to any portion of the Site
  • Engage in automated access, data mining, scraping, or similar unauthorised data collection
  • Transmit any viruses, malware or other harmful content by any means
  • Engage in any activity that could damage, disable, or impair the Site or Services
  • Circumvent, disable, or interfere with security features
  • Engage in activities that infringe on intellectual property rights or violate applicable laws.
  • Impersonate any person or entity or falsely state or misrepresent your affiliation with a person or entity
  • Impersonate Whole Body MRI™, its affiliates, or claim affiliations with Whole Body MRI™ without authorisation.
  • Use Whole Body MRI™’s branding trademarks, logos, or content in any unauthorised manner that could mislead, deceive, or confuse others

9. User Conduct and Compliance

9.1 Accurate Information

You agree to provide truthful, accurate, and up-to-date information when using our Services. Misrepresentation, falsification, or submission of fraudulent information may result in suspension or termination of your account.

9.2 Compliance with Laws

You agree to comply with all applicable local, state and federal laws and regulations when using our Services.

9.3 Respect for System Integrity

You may not attempt to gain unauthorised access to any part of the Site, interfere with system functionality, or breach security measures. Violations may lead to termination of access and possible legal action.

10. Intellectual Property

All content, trademarks, logos, text, graphics, designs, software and video files and intellectual property rights related to our Services, including Whole Body MRI™ scan images (e.g. DICOMS) and Reports are owned by Whole Body MRI™ and is protected by Australian and international copyright laws.

The look and feel of this Site, including the button icons, scripts, and custom graphics, are the trademarks of the Company. These may not be used without prior written consent.

You may download and print content for personal, non-commercial use only, provided you do not remove or modify any copyright, trademark, or proprietary notices. You may not copy, modify, distribute, or create derivative works of any content without our express written consent.

Unauthorised use, reproduction or distribution of these images, including for marketing or promotional purposes, by any third-party is strictly prohibited. We reserve the right to take legal action to protect our intellectual property.

You agree not to attempt to reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code, algorithms, or trade secrets associated with our Services or related technology. Any such unauthorised actions will be considered a violation of these Terms and may result in legal action.

11. Non-compete and Anti-Competitive Conduct

No competitor or associated entity may use, reference or benefit from Whole Body MRI Pty Ltd, domain names, business names, or affiliated content without express written consent. Any attempt to do so constitutes a breach of these Terms and will result in legal action.

Whole Body MRI Pty Ltd retains ownership of all associated domain names, business names and trade names. Any unauthorised attempt to use, transfer, sell or assign these assets is strictly prohibited. We reserve the right to take legal action to prevent any misuse or unauthorised transfer of our business identity.

12. Technology and Security

You agree not to:

  • Interfere with, disrupt or compromise the security or integrity of the Site or Services
  • Attempt to probe, scan or test system vulnerabilities
  • Use any automated means (e.g. bots, spiders) to access or monitor the Site
  • Launch any denial-of-service (DoS) attach or similar harmful activity.

13. Limitation of Liability

This Site, and related Services is provided on an “as is” basis, and we make no guarantees as to the reliability, accuracy or completeness of this Site or its content. Whole Body MRI™ Site or Services may use links to third-party Websites or resources. We are not responsible for the content or services provided by these third-party websites and is not liable for any loss resulting from their use.

To the maximum extent permitted by law, Whole Body MRI Pty Ltd and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to the use of our Site or Services. In no event shall our total liability exceed the amount paid by you for the Services.

13.1 No Guarantee of Detection or Diagnosis

While we strive to provide high-quality imaging services, Whole Body MRI Pty Ltd make no guarantee that scans or reports will detect all medical conditions, including but not limited to cancer, tumours or other abnormalities. The scans and reports are intended for informational purposes only and should not be solely relied upon for medical diagnosis, treatment or decision-making, unless otherwise specified. You acknowledge and agree that Whole Body MRI™ is not responsible for any missed or undiagnosed conditions, and it is your responsibility to seek further evaluation from a qualified healthcare provider for appropriate follow up tests and care, where appropriate.

14. Indemnification

You agree to indemnify and hold Whole Body MRI™, its officers, directors, employees, consultants, licensors, partners, affiliates and agents harmless from any claims, losses, liabilities, damages, costs, and expenses arising from your use of our Site, Services or your breach of these Terms.

You further agree to indemnify and defend Whole Body MRI™ against any claims, damages, or liabilities arising from the impersonation of Whole Body MRI, unauthorised use of our trademarks, or misleading representation of affiliation with Whole Body MRI™ by third parties.

15. Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Queensland, Australia, and any other relevant state, territory, or federal laws.

Any dispute, controversy, or claim arising out of or relating to these Terms or your use of our Services shall be resolved by arbitration in Queensland. Arbitration will be confidential, binding, and subject to Queensland laws. You agree to waive any right to pursue claims in a court of law.

16. Modifications to the Terms

We may update these Terms periodically to reflect changes in our Services or applicable laws. Any changes will be posted on our Site, and your continued use of the Services constitutes acceptance of the revised Terms.

17. Termination

We reserve the right to suspend or terminate your access to the Services at our sole discretion, without notice, if you breach these Terms.
